These Terms of Service ("Terms") govern your use of the BuildStamp service ("Service") operated by Homenids, LLC ("Company", "we", "us", "our"), a Delaware limited liability company.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
BuildStamp provides a record-preservation service only. The Service does not analyze, interpret, verify, certify, or evaluate the accuracy, completeness, or legal sufficiency of user-submitted records.
The Service creates timestamped, append-only records based solely on content submitted by users. BuildStamp does not confirm submission, receipt, acceptance, or compliance with any government, regulatory, or third-party system.

Users agree that BuildStamp shall not be relied upon as the exclusive custodian, authoritative source, or sole basis for legal, compliance, contractual, or evidentiary decisions.
The Service is designed to supplement, not replace, existing documentation practices and systems. Users must maintain independent copies and systems as appropriate for their requirements.
BuildStamp does not provide legal, compliance, regulatory, or professional advice of any kind. The Service does not determine legal sufficiency, admissibility, or outcome of any matter.
Users should consult qualified professionals for guidance on legal, compliance, or evidentiary matters.
Records are preserved in an append-only format. Once created, entries cannot be silently edited or deleted. Corrections or updates are added as new entries with new timestamps.
BuildStamp does not review, validate, or verify the content of user-submitted records.
BuildStamp retains preserved records while the Service remains operational and the User maintains an active subscription or valid access period.
Retention periods described in pricing plans represent maximum intended availability and do not constitute a guarantee of availability for any specific duration.
BuildStamp is not intended to serve as the sole or authoritative system of record for statutory, regulatory, contractual, or legal retention requirements.
Users are solely responsible for exporting and maintaining independent copies of records to satisfy any long-term retention obligations.
In the event BuildStamp elects to discontinue the Service:
BuildStamp does not guarantee availability of records beyond the operational life of the Service.
The Service is provided on an "as-is" and "as-available" basis. BuildStamp does not guarantee uninterrupted operation, error-free performance, or prevention of data loss.
Users acknowledge that technical failures, third-party service interruptions, security incidents, or infrastructure changes may result in loss, corruption, or unavailability of data.
Users are responsible for maintaining independent backups and should not rely solely on the Service for critical data preservation.
Subscription fees are billed in advance on a monthly basis. One-time access fees (such as Dispute Packages) are charged at the time of purchase.
Subscriptions automatically renew unless cancelled before the next billing date. Cancellation takes effect at the end of the current billing period.
Unused allocation (timestamps, storage, access time) does not roll over between billing periods.
Users may cancel subscriptions at any time. To avoid charges for the next billing period, cancellation must be completed at least 24 hours before your billing date (the same calendar day each month as your initial signup).

BuildStamp is designed for professional documentation purposes. The following limits apply:
Excessive usage that impacts service quality for other users may result in throttling, suspension, or termination without refund. BuildStamp reserves the right to modify these limits at any time.
Users retain ownership of content they submit. By using the Service, users grant BuildStamp a limited license to store, process, and display submitted content solely for the purpose of providing the Service.
BuildStamp and its associated trademarks, logos, and service marks are the property of Homenids, LLC.
To the maximum extent permitted by law, BuildStamp's total liability for any claims arising from or relating to the Service shall not exceed the fees paid by the User in the most recent billing period, capped at $100 USD.
In extreme circumstances involving documented gross negligence by BuildStamp, absolute maximum liability shall not exceed $200 USD under any circumstances.
BuildStamp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of business opportunities, or legal costs and fees.
Users agree that any claims arising from or relating to these Terms or the Service must be brought in an individual capacity only and not as part of any class, collective, consolidated, or representative action or proceeding.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
BuildStamp does not warrant that the Service will meet your requirements, operate without interruption, or be error-free.
Users agree to indemnify and hold harmless BuildStamp, Homenids, LLC, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
Before initiating any legal action, parties agree to attempt to resolve disputes through good-faith negotiation. Written notice of the dispute must be sent to legal@buildstamp.co and include a description of the issue and proposed resolution.
If negotiation fails after 30 days, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will be conducted in Delaware.
Small claims court remains available for disputes within its jurisdiction. This arbitration provision does not prevent either party from seeking injunctive relief in court for intellectual property matters or urgent circumstances.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
BuildStamp reserves the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after modifications constitutes acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, Disclaimer, and any other policies referenced herein, constitute the entire agreement between you and BuildStamp regarding the Service.
